AI regulation has gone properly global and entered the legal big leagues. If your AI is in production, it’s more than likely in scope.

So what?

If you’re building or deploying AI in regulated environments, the question is no longer “Is there regulation?”
It’s “Which regime applies, and can you prove control?”

  • Builders can become “accidental providers” the moment they ship AI functionality.

  • Deployers still need governance artefacts, monitoring, and incident readiness.

  • Agentic systems raise the bar again: autonomy means permissions, audit trails, and containment become table stakes.

If you thought the G20 OTC derivatives reforms were chaotic, AI regulation is a different sport. More jurisdictions, faster cycles, and far less agreement on the rulebook.

The US is doing it state-by-state: California’s SB 53 (TFAIA), and Texas HB 149 (TRAIGA), effective 1 Jan 2026.

Add federal politics into the mix and you get the usual outcome: uncertainty and likely litigation, rather than a neat, unified rulebook.

This isn’t “EU vs Silicon Valley” anymore if it ever was. It’s a global patchwork. And it applies to model builders and deployers.

The direction of travel by region is a mix of law, treaty, regulator guidance, and procurement expectations, which is exactly the point.

Europe

  • Council of Europe: a legally binding AI treaty is now on the table, explicitly anchored in human rights, democracy, and rule of law.

  • EU: the EU AI Act is role-based (provider, deployer, importer, distributor) and adds specific obligations for general-purpose AI model providers, supported by the EU’s GPAI Code of Practice route.

  • Russia: the direction of travel is “AI sovereignty + data control”, with public efforts to reduce reliance on foreign LLMs and push domestic capability.

  • Switzerland: not copy-pasting the EU AI Act. It signed the Council of Europe AI Convention and plans Swiss-law adaptations instead.

  • UK: no single horizontal AI law (yet). A regulator-led, “pro-innovation” approach instead. Translation: you still need controls, just with different wrappers.

Americas

  • Argentina: still fragmented, but there are active proposals and protocols emerging across sectors.

  • Brazil: AI regulation is advancing via Bill PL 2,338/2023. The Senate approved it in Dec 2024 and it’s been moving through the process since.

  • Chile: launched a national AI policy and introduced an AI bill (2024), and it’s continued progressing with amendments.

  • Colombia: adopted a formal National AI Policy (CONPES 4144) in Feb 2025, alongside ongoing efforts to strengthen governance.

  • Canada: no single “AI Act” in force yet; policy direction is moving via proposed legislation and voluntary governance expectations for advanced GenAI.

  • US: California’s SB 53 (TFAIA) is aimed at frontier model developers, with safety framework and incident-style obligations. Texas HB 149 (TRAIGA) is broader and explicitly names duties for developers and deployers.

Middle East

  • Bahrain: has published an AI RAM Report (Nov 2025) framing national AI governance around fairness, accountability, and rights-respecting adoption. It’s not an “AI Act”, but it’s a clear governance direction of travel.

  • Qatar: the Qatar Central Bank AI Guideline (2024) applies to QCB-licensed financial firms using AI, covering governance, lifecycle management, data governance, and human oversight.

  • Saudi (KSA): SDAIA AI Ethics Principles explicitly apply across the lifecycle to stakeholders designing, developing, deploying, implementing, and using AI systems in KSA.

  • UAE: has a national AI Charter baseline. DIFC Regulation 10 covers personal data processed through autonomous and semi-autonomous systems

Africa

  • Africa: the African Union endorsed a Continental AI Strategy with phased implementation planning (2025–2030).

  • South Africa: published a National AI Policy Framework (Oct 2024) as the base layer for governance, alongside existing privacy law (POPIA) that already bites in practice.

  • Kenya: has a National AI Strategy 2025–2030 (published as a government PDF), explicitly positioning this as groundwork for future regulation.

  • Nigeria: has a National AI Strategy document (2024). Again: not an “AI Act”, but it sets direction and expectations.

 Asia Pacific

  • Australia: the government’s Voluntary AI Safety Standard is now a reference point for governance expectations and “guardrails” adoption. Regulators are still sharpening tools (and the politics can flip quickly).

  • China: draft measures now target human-like, emotionally interactive AI services. If your “agent” behaves like a person, China wants rules around it.

  • India: no single AI act, but governance is arriving via platform advisories, data protection, and a growing push for formal AI governance structures.

  • Japan: published AI governance guidelines for business to drive safer adoption aligned with global trends.

  • Singapore: practical governance tooling (AI Verify and related frameworks) that firms are increasingly using as “show me your workings” evidence. MAS has a live consultation on AI Risk Management Guidelines for all FIs, with consultation running to 31 Jan 2026.

  • New Zealand: policy-led approach (public-sector algorithm/AI governance and responsible-use frameworks) rather than a single horizontal AI Act.

  • Türkiye: no single AI Act yet, but a national AI strategy plus draft legislative activity signals tightening oversight, largely EU-influenced.

 Global financial regulators converging (quietly)

  • FSB: pushing authorities to get better at monitoring AI adoption and vulnerabilities in finance. Translation: expect more supervisory questionnaires, taxonomies, and “show me your controls” moments.

  • NIST: drafting implementable AI security overlays and profiles that risk teams can actually use without needing a philosophy degree.

  • ISO/IEC 42001: increasingly the “auditable wrapper” organisations are using for AI management systems.

What this means for Big Tech (OpenAI, Google, Microsoft, Meta)

Big Tech gets regulated first. Everyone else inherits the controls.

Frontier-model regimes and GPAI obligations land on the largest model providers first. They respond by turning compliance into product features and contract terms: tighter logging, stricter agent permissions, safer defaults, clearer usage restrictions, stronger incident processes.

Expect this to show up as feature flags (logging on by default), stricter tool permissions for agents, and tougher enterprise contract clauses. The friction flows downstream to every bank, investment firm, fintech, and vendor building on top of them.

How this hits builders vs deployers

Builders (you package AI into a product):
You can become an “accidental provider” the moment you commercialise AI functionality. That pulls in documentation, testing evidence, monitoring, and lifecycle controls. Role-mapping matters.

Deployers (you use AI inside your business):
You still need governance artefacts, monitoring, and incident playbooks, especially in regulated workflows. Texas makes this explicit by naming “deployers”.

Agentic deployments (tools, actions, workflows):
Permissioning, audit trails, and a tested kill switch stop being “nice-to-have” and become table stakes.

What to do next (practical, not performative)

  1. 🧱 Build one global AI governance baseline (controls + evidence pack), then layer jurisdiction deltas.

  2. 🧪 Stress-test agentic behaviour: permission creep, prompt injection, unsafe tool use, runaway loops.

  3. 🛑 Implement a real kill switch: owners, triggers, escalation path, and proof it actually works.

  4. 🧩 Fix role confusion early: builder vs deployer vs “accidental provider”.
